EFFNetwork is a nonprofit association that was founded in Barcelona, Spain; first in December 2002 as EEFFN and in February 2008 EFFN (Environmental Film Festival Network), as recorded in its Founding Deed and Articles of Association, and is holder of the domain name effnetwork.org, granted for use by the International Environmental Film Festival Association, of which the Chairman is Claudio Lauria, as recorded in the ICAAN Public Interest Registry.
For further information the internet domain registry can be consulted at: http://www.whois.net/whois/effnetwork.org
One of EFFN’s goals is to extend the scope of this NONPROFIT entity to other countries in Europe and throughout the world, participating in and promoting the creation of ‘associations with the same name, strictly national or local in nature’ in those countries which wish to do so. This was the case for Italy, where on 14 May 2008, Mr Gaetano Capizzi and Ms Erica Girotto registered the association EFFNetwork in Turin, Italy, appointing a Board of Directors composed of: Gaetano Capizzi, Lucía Rikaki and Claudio Lauria. The inclusion of Claudio Lauria on the Board of Directors of EFFNetwork created in Turin (Italy), in the capacity of First Deputy Chairman, guaranteed, enabled and contributed the use of the association’s name, the entity’s logo and effnetwork.org (abbreviation of Environmental Film Festival Network on the internet), registered in Barcelona, Spain by the International Environmental Film Festival Association in 5th March 2008, which is holder of the domain effnetwork.org as recorded in the ICAAN Public Interest Registry.
On 24 April 2009, Mr Gaetano Capizzi gave notice of his resignation from the position of Chairman of the Board of Directors of EFFNetwork in Turin, and, in light of this, Mr Claudio Lauria, First Deputy Chairman, temporarily took on and accepted the position of Chairman of EFFNetwork in Italy, in order to either extend the life of or dissolve the association.
Through the present statement (and simultaneously by certified post) Mr Claudio Lauria, Chairman of the EFFNetwork Association in Turin, Italy, gives notice of his RESIGNATION and calls for the dissolution of said association. He prohibits the use of the acronym EFFN, effnetwork, effnetwork.org and Environmental Film Festival Network, closes the association’s bank account in Turin and prohibits any other activity by the association in said city in its name or in the name of EFFNetwork, taking into consideration that the founding OBJECTIVES, which form an essential part of the Articles of Association of EFFNetwork in Barcelona, have not been pursued.
Notice is hereby given that the resignation of two thirds of the Board of Directors of the association EFFNetwork in Turin (Gaetano Capizzi and now Claudio Lauria), leaves the entity without proper leadership, and therefore said association should be dissolved.
Festivals which are friends of the EFFNetwork are invited to continue participating through EFFNetwork.org to create the largest solidarity-based, communication and distribution network in the world of International film festivals related to environmental matters, in order to exchange experiences and create interaction between festivals, with the aim of generating maximum exposure for our work.
We are pleased to inform you that: prior consent from their only real holders is required for use of the name EFFN (Environmental Film Festival Network), EFFNetwork or its counterpart on the internet (effnetwork.org) and the graphic design and logo. The improper use thereof violates the rights of their holders and will be sufficient grounds to initiate legal action preventing such use before the Courts of Barcelona.
Note on second thought:
The recently notified change to the date of the Cinemambiente Festival, now to be held from 1 to 6 June (after 12 years of holding it in October) so that it coincides with FICMA (International Environmental Film Festival), is evidence of a lack of solidarity and an unpleasant competitive spirit on the part of the director of Cinemambiente, the former Chairman of the EFFNetwork in Turin.
Best wishes and Happy New Year!
Founder and Chairman of EFFNetwork
